These terms are between you and SkyAudio (the "seller"). By creating an account, purchasing, or continuing to use the diffuser designer service, you agree to these terms. You confirm you are of legal age or have authority to bind the organisation you represent.
SkyAudio provides a web tool for designing acoustic diffuser panels and purchasing the resulting 3D-printable files (STL/ZIP), either per design or through a monthly unlimited-downloads subscription. Downloads are licensed to you with a limited, non-exclusive, non-transferable right to use the purchased files, within the plan you selected.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms (https://www.paddle.com/legal/checkout-buyer-terms) and Paddle's Refund Policy (https://www.paddle.com/legal/refund-policy). Subscriptions renew monthly until cancelled; cancellation takes effect at the end of the paid period.
You must not misuse the service: no unlawful use, fraud or spam, infringement of others' intellectual property, or interference with the service's security (including malware, probing, or scraping). You must not reverse engineer, resell, or redistribute the service, or circumvent its technical limits. You are responsible for keeping your account credentials confidential, for all activity under your account, and for providing accurate account information.
The service, including its software, documentation and branding, remains the property of SkyAudio. Designs you configure belong to you; you grant SkyAudio a limited licence to process them solely to provide the service (rendering previews, generating export files, and archiving your purchased downloads).
The service is provided "as is" without any guarantee of uninterrupted or error-free performance, and all implied warranties (including merchantability and fitness for a particular purpose) are disclaimed to the fullest extent permitted by law. Generated files should be validated before manufacturing. To the extent permitted by law, SkyAudio is not liable for indirect or consequential damages (including loss of profits, data, or goodwill), and its aggregate liability is capped at the fees you paid in the 12 months preceding the claim. Nothing in these terms excludes liability for fraud, death, or personal injury where the law requires otherwise.
We may suspend or terminate your access for material breach, non-payment, security or fraud risk, or repeated or serious violations of these terms. You may request account deletion at any time from your account settings; purchased downloads and billing records are handled as described in the Privacy Notice.
These terms are governed by the laws of the seller's jurisdiction, and disputes are subject to its courts unless mandatory consumer law provides otherwise. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. We are not responsible for delays caused by events beyond our reasonable control.
